Room Ready
Terms of Service
Effective October 24, 2026
Please read these Terms. They include an agreement to resolve disputes through individual arbitration instead of in court, except small claims, and a waiver of class actions and jury trials. See Arbitration and class action waiver. You can opt out of arbitration within 30 days after you first agree.
1. This agreement
These Terms of Service (the “Terms”) are an agreement between you and Throughpoint Advisory LLC, a New York limited liability company (“Throughpoint,” “we,” “us,” or “our”). Room Ready, previously named First Chair, is a product of Throughpoint. These Terms cover beroomready.com, firstchairhq.com, and any other site or app where we offer Room Ready; your record; your briefs; the resume and LinkedIn add-on; and every other Room Ready product, file, email, or message (together, the “Service”).
You accept these Terms when you check the box agreeing to them or when you use the Service. If you do not agree, do not use the Service. Our Privacy Policy explains how we collect and use information, and our Consumer Health Data Privacy Policy applies to Washington and Nevada residents. Please read both.
2. Who can use Room Ready
- You must be at least 18 years old, live in the United States, and be able to enter a binding contract.
- The Service is for your own job search and career. It is not for employers, recruiters, or anyone evaluating candidates, unless we agree otherwise in writing. Coaches and other partners use the Service under a separate agreement with us.
- While Room Ready is invite-only, only invited email addresses can use it.
- Give us accurate information, keep one account per person, and do not share your account.
You sign in with a link sent to your email, so anyone who can read your email can sign in as you. Keep your email account secure. You are responsible for everything done through your account. Tell us right away at support@beroomready.com if you think someone else has used it.
3. What Room Ready is, and what it is not
Room Ready helps you prepare for job interviews. It helps you build your record, a checked account of your career, and from that record, the job posting, public research, and what you share with us, it builds a brief for each interview and related materials.
Room Ready is not an employment agency, recruiter, staffing firm, job listing service, or placement service. We do not find jobs for you, refer you to employers, submit applications for you, or represent you to employers, and we do not claim that we can. No verbal or written promise or guarantee of any job or employment is made or implied. We do not promise interviews, offers, a level, a title, or any amount of pay. Results depend on you, on employers, and on the job market.
Room Ready does not give legal, tax, financial, investment, immigration, medical, or mental health advice. Offer guidance, pay figures, equity math, and negotiation suggestions are general information to help you prepare. They are not advice about your situation. Before you make a decision with legal, tax, or financial consequences, such as signing an offer, an employment agreement, or a separation agreement, talk to a qualified professional. Using the Service does not create an attorney, fiduciary, or other professional relationship between you and us.
Room Ready uses artificial intelligence, and AI can be wrong. We use AI, including Anthropic’s Claude, to read your answers, ask follow-up questions, draft text, research employers and interviewers, and build briefs. AI can misstate facts, miss context, rely on public sources that are wrong or out of date, and write things that sound right and are not. The checks we run reduce errors. They do not remove them. Scores and ratings in a brief, such as the Match Meter, are opinions to help you prepare. They are not measurements or predictions.
You decide what to say. Before you say, send, submit, or sign anything the Service helped you prepare, read it and confirm it is true and right for you. You alone are responsible for what you say in an interview and for every document you give an employer.
4. Your responsibilities
Tell the truth. You are responsible for the truth of everything you give us and everything you tell an employer. Do not use the Service to invent or inflate experience, titles, dates, degrees, credentials, figures, or references. Your record pushes back on claims it cannot support, but it cannot know your history better than you do.
Keep out what you are not allowed to share. Do not give us an employer’s or client’s confidential information or trade secrets; classified, export-controlled, or other restricted information; patient, client, or customer records; anything covered by a nondisclosure, confidentiality, or interview agreement; or anyone’s government ID numbers or health information. Your agreements with current and former employers, clients, and licensing bodies are between you and them. We are not a party to them, and we cannot tell you what they allow. If you are not sure whether you may share something, leave it out, or ask someone who can tell you, such as your own lawyer.
Recordings and transcripts are your responsibility. We do not record your conversations, and you never need a recording to use Room Ready: notes you write afterward work too. We work from transcripts and notes, so please do not send us audio or video. Many states require everyone in a conversation to agree before it is recorded, and many employers forbid recording interviews or using AI note takers. Before you record or transcribe a conversation, you are responsible for getting every consent the law and the other people in it require, and for following any rule the employer has set. When you give us a transcript, or a Partner gives us one for you, you are confirming that it was made and shared with every consent the law and the employer require. Do not give us a transcript you were not allowed to make or to share.
Follow each employer’s rules on AI. Some employers do not allow AI tools during interviews, assessments, or work samples, or in application materials. The Service is for preparing before a conversation and learning from it after. Do not use it during a live interview, or to complete an assessment or work sample where AI is not allowed. Following each employer’s rules is your responsibility.
Respect the people in your story. Your record and briefs may include information about other people, such as former colleagues, references, and interviewers. Give us only information you have a right to share. Use what the Service gives you about other people only for your own job search, and never to harass, embarrass, pressure, or discriminate against anyone.
5. Rules for using Room Ready
You agree not to do any of the following, or help anyone else do them:
- break any law or violate anyone’s rights, or use the Service to deceive an employer;
- copy, scrape, crawl, or download the Service or its content by automated means, other than the files the Service gives you to save;
- reverse engineer, decompile, or try to discover the Service’s source code, prompts, instructions, or methods, including by trying to get the AI to reveal its instructions;
- use the Service or anything it produces to build, train, or improve a competing product or any AI model;
- get around usage limits, access controls, payment, or the invitation list, or use another person’s account;
- probe, scan, or test the Service’s security, interfere with how it runs, or upload malware or anything else harmful;
- resell, sublicense, or share access to the Service, or offer it to others as a service;
- submit content that is unlawful, infringing, or abusive; or
- impersonate anyone or misstate your connection with anyone.
6. Your content
You keep ownership of what you give us: your answers, documents, notes, transcripts, and other materials (“Your Content”).
You give Throughpoint a worldwide, non-exclusive, royalty-free license, for as long as we hold Your Content, to host, store, copy, process, analyze, transmit, adapt, and display it, and to let our service providers do the same on our behalf, in order to provide, secure, support, and improve the Service, consistent with our Privacy Policy. You also agree that we may create information from Your Content that is de-identified or combined with other information so that it does not identify you, and use it for any lawful purpose.
You promise that you have every right and consent needed to give us Your Content, and that Your Content, and our use of it under these Terms, will not violate any law, any agreement you are bound by, or anyone’s rights.
We are not required to review Your Content. We may refuse, remove, or stop processing any of it at any time. Keep your own copy of anything important to you. You can save your record file from the record’s last step, and you can ask us for a copy at any time.
7. What we own, and what you may do with your deliverables
The Service and everything in it, other than Your Content, belongs to Throughpoint or its licensors. That includes the Room Ready method, prompts, software, designs, templates, the structure and format of records and briefs, and the Room Ready name and mark. These Terms give you no rights in any of it except the limited rights in this section.
“Deliverables” are the records, briefs, documents, and other output the Service produces for you. As long as you follow these Terms and have paid what you owe, we give you a personal, non-exclusive, non-transferable license to use your Deliverables for your own job search and career. You may use the resume and LinkedIn text the Service writes for you any way you like for your own career, including sending it to employers and posting it. Your record is yours to keep and use for your own career.
You may share a brief privately with people who are advising you, such as a coach, a lawyer, or a family member. You may not publish, sell, or distribute a brief, use a brief or a record for anyone else’s job search, or remove the Room Ready name or mark from a brief. The parts of a Deliverable that are Your Content remain yours.
If you send us ideas, suggestions, or feedback, we may use them for any purpose without paying you or owing you anything.
8. Invitations, testing, and changes
Room Ready is new and still changing. While it is invite-only, some features may be free, unfinished, or open only to some accounts. We may add, change, limit, or stop any feature, product, or free offer at any time, and we have no obligation to keep any of them. Free and test features are provided with no commitment of any kind.
We may set or change limits on use, such as how many AI steps an account can run in a day.
9. Purchases and payment
- Prices are shown before you pay. We may change prices at any time. A change never affects a purchase you have already made. Taxes are added where the law requires them.
- Payments are handled by Stripe. By paying, you also agree to Stripe’s terms for that payment, and you authorize us, through Stripe, to charge the payment method you give for the purchase you confirm.
- Each purchase covers what was described at checkout, for one person. A purchase cannot be transferred, shared, or exchanged for cash, and unused parts do not carry over unless the description at checkout says they do.
- If a price or description is wrong, we may cancel the order and refund what you paid.
- We aim to deliver in the time stated at checkout. Delivery depends on you giving us what we need, such as the job posting and your interview details, in time.
10. Refunds and cancellations
A purchase is final once work on it has started. Work starts when you first open the part of the Service you bought, or when we start building a brief you ordered. Before work starts, you may cancel for a full refund by emailing us.
We do not give refunds for unused parts of a purchase, for a change of mind, or because of how an interview or a search turned out.
If we do not deliver something you paid for, we refund that purchase in full. We have not delivered if we tell you we cannot build it, or if it is more than 7 days past the delivery time stated at checkout and the delay was not caused by you. Ask for this refund within 30 days after the stated delivery time. A full refund under this section is your only remedy for a purchase we did not deliver.
Where a law gives you a right to cancel or to a refund that these Terms do not, you keep that right.
If you think a charge is wrong, email us first and we will look into it. If you dispute a charge with your bank or card issuer for something we delivered, we may suspend your account while the dispute is open, and we may give the bank or card issuer the records it needs to decide it.
11. Coaches and partners
If you came to Room Ready through a coach, career service, or other partner (a “Partner”), the Partner is independent of us and is not our agent. We are not responsible for a Partner’s advice, services, conduct, fees, or handling of information. As our Privacy Policy explains, a Partner can see your progress and your finished record, and may receive the briefs built through its program. Your own agreement with a Partner may also apply to you.
12. Ending your account
You may stop using the Service and close your account at any time from your account page. Closing an account does not entitle you to a refund except as the refund section above says.
We may suspend or end your access, or remove Your Content, at any time if we believe you have broken these Terms or the law, if your use creates risk or possible legal exposure for us or for others, if the law requires it, or if we stop offering the Service. If we stop offering the Service entirely for a reason other than your conduct, we will refund paid work we have not yet started.
What happens to your information when an account ends is explained in our Privacy Policy. The sections on your content’s license (only as long as we hold Your Content), what we own, disclaimers, limits on liability, your promise to cover claims, disputes, governing law, and general terms continue after your account ends.
13. Services we rely on
The Service relies on, and may link to, services we do not control, such as Stripe, Anthropic, email providers, and employers’ websites. We are not responsible for them, and your use of them is under their own terms.
14. Disclaimers
The Service and all Deliverables are provided “as is” and “as available.” To the fullest extent the law allows, Throughpoint disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy, and any warranty arising from a course of dealing or usage of trade.
We do not promise that the Service will be uninterrupted, secure, or free of errors; that any content or Deliverable will be accurate, complete, or current; that Your Content will not be lost; or that using the Service will lead to any interview, offer, or other result.
15. Limits on our liability
To the fullest extent the law allows:
- Throughpoint and its members, managers, employees, contractors, and agents (the “Throughpoint Parties”) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost wages or earnings, lost job opportunities or offers, lost data, harm to reputation, or emotional distress, arising out of or related to the Service or these Terms, even if we were told they were possible.
- The Throughpoint Parties’ total liability for all claims arising out of or related to the Service or these Terms, combined, will not exceed the greater of the amount you paid us in the 12 months before the event that gave rise to the claim, or $100.
These limits apply to every theory of liability, including contract, tort (including negligence), strict liability, and statute, and even if a limited remedy fails of its essential purpose. They are a basic part of the bargain between you and us, and our prices reflect them. They do not limit liability for gross negligence, willful misconduct, or fraud, or any other liability the law does not allow to be limited. Some states do not allow some of these limits. In those states, our liability is limited to the smallest amount the law permits.
16. Your promise to cover claims
You will defend, indemnify, and hold harmless the Throughpoint Parties from and against any third-party claim, and the losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) that come with it, to the extent it arises from Your Content; your breach of these Terms; your violation of any law or of anyone’s rights, including any confidentiality agreement, employer policy, or recording law; or what you choose to say or submit to an employer. This does not cover a claim to the extent it arises from content we wrote, unless it comes from information you gave us that was false or that you were not allowed to share, or a claim that arises from our own breach or negligence. We may take over the defense of any such claim, and you will cooperate with us. You may not settle a claim that affects us without our written consent.
17. Resolving a dispute informally first
Before either of us starts an arbitration or a court case, we each agree to try to settle the dispute informally. The party with the dispute sends a written notice describing it and the relief requested, with the sender’s name and account email address. Send yours to support@beroomready.com and to Throughpoint Advisory LLC, c/o Northwest Registered Agent LLC, 418 Broadway, Ste N, Albany, NY 12207. We will send ours to your account email address. Neither of us may start an arbitration or a lawsuit until 60 days after the notice is received, and any deadline for bringing the claim is paused during those 60 days.
18. Arbitration and class action waiver
Agreement to arbitrate. You and Throughpoint agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any Deliverable, or our relationship, whether based on contract, tort, statute, or any other theory, and whether it arose before or after you agreed to these Terms (a “Dispute”), will be resolved by final and binding individual arbitration, not in court. The Federal Arbitration Act governs this section.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies and stays there. Either of us may also ask a court for an injunction or other equitable relief to stop infringement, misappropriation, or misuse of intellectual property, of the Service, or of its security.
Rules. The arbitration will be run by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules, as in effect when the arbitration is filed and as changed by this section. The rules are at adr.org. One arbitrator will decide the Dispute. The arbitrator may award any individual relief a court could award to an individual, but only in favor of the individual party seeking it and only as far as needed for that party’s individual claim. Unless the arbitrator decides otherwise, any hearing will be held by video or phone. If an in-person hearing is needed, it will be held in the county where you live or in New York County, New York, as you choose. Fees will be paid as the AAA’s rules provide. The arbitrator’s decision is final, and judgment on it may be entered in any court with jurisdiction.
Who decides. The arbitrator decides every question about a Dispute, including whether it must be arbitrated and the scope, validity, and enforceability of this section, except that a court decides any question about the class action and jury waiver below.
Class action and jury waiver. You and Throughpoint each agree to bring Disputes only in an individual capacity, and never as a plaintiff or class member in any class, collective, consolidated, or representative action or arbitration. The arbitrator may not combine more than one person’s claims or preside over any class, collective, or representative proceeding, except as the AAA’s Mass Arbitration Supplementary Rules allow for administration. You and Throughpoint each give up the right to a jury trial and to take part in a class action.
If a court decides that the class action and jury waiver cannot be enforced for a particular claim or remedy, including a claim for public injunctive relief that the law does not allow to be waived, that claim or remedy, and only that one, will be separated and decided by a court in New York County, New York, after any claims that must be arbitrated have been arbitrated. The rest of this section still applies.
Opting out. You may opt out of this agreement to arbitrate by emailing support@beroomready.com from your account email address within 30 days after the first time you agree to any version of these Terms, with your name and the words “I opt out of arbitration.” Opting out does not change any other part of these Terms.
Changes to this section. A change to this section does not apply to a Dispute either of us has already given notice of. You may reject a future change to this section by emailing us within 30 days after it takes effect, and your Disputes will then be governed by the version of this section that applied before that change.
19. Governing law and courts
New York law governs these Terms and any Dispute, without regard to its conflict of law rules, except that the Federal Arbitration Act governs the arbitration section. For any Dispute that is not arbitrated, you and Throughpoint agree to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
20. Changes to these Terms
We may change these Terms. We will post the new version here with a new effective date. If a change is material, we will tell you by email or in the Service before it takes effect, and we may ask you to agree to the new version before you keep using the Service. A change takes effect on the date posted, or, for a material change, on the earlier of 30 days after we notify you or the day you agree to it. If you do not agree to a change, stop using the Service and close your account. A change does not apply to a Dispute either of us has already given notice of. Agreeing to a new version does not take away your right, described in the arbitration section, to reject a change to that section.
21. General terms
- Entire agreement. These Terms, together with any terms shown at checkout, are the whole agreement between you and us about the Service. They replace any earlier agreement about the same subject.
- Time to bring a claim. To the extent the law allows, any claim arising out of or related to the Service or these Terms must be started within one year after it arose, or it is permanently barred.
- Transfer. You may not transfer these Terms or your account. We may transfer these Terms, in whole or in part, including to an affiliate, to a successor in a merger, acquisition, reorganization, or sale of assets, or to another company that takes over Room Ready.
- If a part is unenforceable. If any part of these Terms is found unenforceable, the rest stays in effect, and that part is enforced as far as the law allows, except as the arbitration section says for the class action and jury waiver.
- No waiver. If we do not enforce a part of these Terms, that is not a waiver of our right to enforce it later.
- Events outside our control. We are not responsible for a delay or failure caused by events outside our reasonable control, including outages at our providers, internet or power failures, natural disasters, illness, labor disputes, government action, or attacks on our systems.
- Electronic communications. You agree to receive notices, agreements, receipts, and other communications electronically, by email to your account address or in the Service, and that they satisfy any requirement that they be in writing. An email notice is given when it is sent. Keep your account email address current.
- Our relationship. We are independent of each other. These Terms do not create a partnership, employment, agency, or fiduciary relationship.
- No third-party rights. No one else has rights under these Terms, except the Throughpoint Parties under the sections on limits of liability and covering claims.
- United States only. The Service is offered only in the United States. You may not use or export it in violation of United States export or sanctions laws.
- Reading these Terms. Headings are for convenience only. “Including” means including without limitation. If a translation differs from this English version, this version controls.
